We've tried to keep this simple, but please contact us if you're unsure about anything.

For the purposes of this contract, we’ll refer to “us”, “we” and “Ozeano” interchangeably. Likewise, when we say the “site” or "website" we’re also referring to the services that are provided through it.


This site is owned and operated by Ozeano Vision (ABN: 23914165572). These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors eyewear products. By accessing or using this website, you approve that you have read, understood, and agree to be bound by these Terms.

Our contract with you:

  • These terms and conditions apply:

    • So far as the context allows, to you as a visitor to Our Website; and

    • In any event to you as a buyer or prospective buyer of our Goods.

    • We shall accept your order by e-mail confirmation. That is when our contract is made.

  • We may change these terms from time to time. The terms that apply to you are those posted here on Our Website on the day you order Goods.

  • Unfortunately, we cannot guarantee that Goods advertised on our website are available.

  • If we do not have all of the Goods you order in stock, we will offer you alternatives.  If this happens you may:

    • accept the alternatives we offer;

    • cancel all or part of your order;

  • If in the future, you buy Goods from us under any arrangement which does not involve your payment via Our Website, these terms still apply.

  • If you are not in Australia, we have no knowledge of, and no responsibility for, the laws in your country.

Ordering:

  • Please ensure you double check that you have ordered the correct product and quantity at the check out.

  • Adding an item to the basket does not reserve the item and this may subsequently be sold to another customer.

  • When buying an item, you agree that

    • you are responsible for reading the full item listing before making a commitment to buy it:

    • you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

  • We will not be able to amend orders once dispatched.

  • All orders will receive a confirmation email upon completion. Please allow up to 60 minutes for this to be received and don’t forget to check your junk mail.

  • We reserve the right to accept or reject any order(s)

  • No refunds will be made for orders where discount codes are not entered at point of purchase

Price and Payment:

  • We endeavour to keep Our Website and catalogue prices updated and accurate but it is possible that the price may have increased from that published. If that happens, we will not send your order until you have confirmed that you wish to order at the new price.

  • All online payments must be transacted through our website.

  • ​Prices are final upon payment checkout. In the event the product is subsequently available on sale, refunds will not be allowed for the price difference.

  • The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur.

  • Banking charges by the receiving bank on payments to us will be borne by us. All other charges relating to payment in a currency other than Australian Dollars will be borne by you.

  • Prices include Australian goods and services tax. 

  • All prices are expressed in Australian dollars and, where applicable, include GST. If you order products from our site to an overseas address, then you are solely responsible for all customs, import, excise or tariffs charges and taxes. 

Discount codes:

  • Sometimes, we offer discounted prices on our site. These are at our sole discretion and may change without notice.

  • On some occasions, we also may offer discount codes that entitle a person or class of persons to a special price or offer. These codes are only to be used by the intended bearer and for the purpose indicated when the code is distributed by us.

  • We reserve the right to cancel any codes or modify the price or offer to which the bearer would otherwise be entitled for any reason and without any notice.

  • If you are given a code for a particular purpose, you agree not to share that code with any other person and acknowledge that if it is redeemed by a person other than you, then you may not be entitled to redeem the code.

Social media competition:

  • Anyone buying a Ozeano product directly from our site is immediately eligible to enter the competition.

  • Entry to the competition is done by tagging our social media account, which can be done on Instagram (@ozeano_vision), Facebook (@ozeano.vision) or Twitter (@OzeanoV).

  • Only tags that actually link (i.e. when you click the tag it takes the user to a Ozeano page) will be entered in to the competition  

  • Only 1 tag per profile will be entered in to the competition.

  • There is a 1 in 100 chance of winning. Once 100 unique competition entries are made, we will draw the winner at random. 

  • Winners will be announced on our social media channels, with the winner also receiving a direct message on the social media platform they entered the competition / tagged us on. 

  • Selected winners must be able to provide a valid Ozeano order number dated within the last 6 months.

  • Selected winners must be able to provide a Ozeano order number for a completed order that has not been returned. 

  • Winners will only receive 90% of the purchase price they paid. The remaining 10% will go to our chosen eye care charity. 

  • Winners will receive their money back no sooner than 70 days after their order placement date, to ensure that the product purchased is not returned to us within the '60 day Returns period'.

  • Winners will receive their money back on the same card that was used for the Ozeano order number that is provided. 

Shipping / Delivery:

  • Deliveries will be made by post / a carrier instructed by us to the address stipulated in your order. You must ensure that someone is present to accept delivery.

  • Delivery within Australia is free, though we reserve the right to start charging for delivery at any time and without prior notice. Delivery costs will be made clear to you at the point of purchase on our site

  • International delivery is free, though we reserve the right to start charging for delivery at any time and without prior notice. Delivery costs will be made clear to you at the point of purchase on our site

  • For shipping in Australia, you should expect to receive your goods within 3 - 5 business days.

  • For International shipping, you should expect to receive your goods within 5 - 7 business days subject to normal clearance of customs, but this is completely outside of our control and we can not guarantee shipping within a certain timeframe for international orders. 

  • Please be aware that Ozeano cannot control any customs or import duties applied to your package.  We can’t tell you what the cost will be as customs policies and charges can vary from country to country. It’s a good idea to contact your local customs office before placing an order so you don’t receive any unexpected charges.

  • We accept no responsibility for orders that are delayed due to International customs checks

  • We accept no responsibility for orders that provide an incomplete/incorrect delivery address. This may result in delivery being delayed, lost or returned to us. In the event an order is returned to us by our selected courier, the cost of re-delivery will be incurred to the customer before dispatch, at the same rate as on the original order.

  • If we ourselves are not able to deliver your Goods within 30 days of the date of your order, we shall notify you by e-mail to arrange a later date for delivery and giving you the option of cancelling your order. 

  • We may deliver the Goods in instalments if they are not all available at the same time for delivery.

  • Goods are sent at our risk until signed for by you or by any other person at the address you have given to us.

  • We will send you a message by email to tell you when we have despatched your order.

Cancellation of your order:

  • You may cancel your order at any time before we despatch your order.

  • If you cancel before we have sent the Goods, we will refund to you the price of the Goods.

  • If you cancel after we have despatched the Goods, we will not cancel your order. However, you may return the goods in accordance with our returns policy and we will refund you the price of the Goods, subject to the Goods being complete and in the same condition in which you received them. We cannot refund your money if the Goods have been used, worn or damaged.

  • We will refund your money within 30 days of cancelling with the Goods in our possession or receiving the Goods.

  • This paragraph does not affect your rights in the event that the Goods are faulty.

Returns:

  • If for any reason you are not completely happy with your purchase, just return the Goods within 30 days, and we will offer you a refund of the purchase price, or exchange for a different product.

  • Please retain your order confirmation for any returns, as we'll ask you for details from it when you email us to ask for a return.

  • When returning to us, please ensure:

    • all Goods are packed into their original packaging

    • the package is securely sealed 

    • Goods and all packaging as far as possible are in their original condition; including our invoice and delivery slip;

  • Returns within Australia and Internationally will be at your expense; you will cover the shipping costs for your return(s)

  • Subject to all Goods being returned undamaged, we will refund your money within 30 days of receiving the Goods.

  • For International shipping, if you wish to refuse your delivery, you will still be held responsible for the original customs fees or import duties and the cost of returning the package to Ozeano. The amount will be deducted from your refund. If the fees exceed the amount of your order including shipping costs, the parcel will be destroyed and you will not be refunded.

  • Please email us at contact@ozeano.com.au if you wish to return anything

  • Full details of the returns address and our simple returns process will be provided to you after you have emailed us at contact@ozeano.com.au to advise us that you wish to return an item

Circular economy returns:

  • If you wish to return a old Ozeano product to us, you can do so at any time after the 30 day 'Returns' period and we will issue you with a 25% off discount code to be used on your next purchase

  • Any Ozeano products that are still within their 'Returns' period can not benefit from the 'Circular economy' offer. Only products that have exceeded their returns period can be part of the 'Circular economy' offering.

  • Please retain your order confirmation for any Circular Economy returns, as we'll ask you for details from it when you email us to ask for a return.

  • When returning to us, please ensure:

    • all Goods are packed into their original packaging, or packaging that offers the same level of protection

    • the package is securely sealed 

    • Goods are in their original condition; including our invoice

  • Returns within Australia and Internationally will be at your expense; you will cover the shipping costs and any other charges or fees relating to your return(s)

  • Subject to all Goods being returned undamaged, we will issue your 25% off discount code via email within 30 days of receiving the Goods.

  • The Circular Economy service is offered at our sole discretion and we reserve the right to change, or cancel the offering at any time and without notice.

  • Any 'Circular Economy' discount codes issued to you are only to be used by you and for the purpose indicated when the code is distributed by us.

  • We reserve the right to cancel any codes for any reason and without any notice.

  • If you are given a code for 25% off your next purchase, you agree not to share that code with any other person and acknowledge that if it is redeemed by a person other than you, then you may not be entitled to redeem the code.

  • Please email us at contact@ozeano.com.au if you wish to use our Circular Economy returns service

  • Full details of the returns address and our Circular Economy returns process will be provided to you after you have emailed us at contact@ozeano.com.au

1 Year Warranty:

  • We will replace or repair any purchased Ozeano product within 1 year of purchase where the product is faulty as a result of a manufacturing, material or fitting defect. Ozeano, will not repair or replace any product that is deemed to be damaged from a direct result of obvious stress to the the product or general wear and tear.

  • We do not cover for mistreatment or general wear and tear over time.

  • This warranty applies to frames and lenses sold by Ozeano. It does not apply to pouches or cases that are provided by us for free with your purchase.

  • To request a return, email us at contact@ozeano.com.au. Please include your full name and contact details, your order number, a photo of the Product and a description of what the fault or damage you think has happened to it. 

  • It is up to the discretion of Ozeano, in all their capacity and knowledge to decide the cause of a defect or break to a Ozeano product.

  • We will endeavour to respond to all emails within 48 hours.

  • You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time. 

Site access: 

When using our site, you agree and covenant not to do any of these things: 

  • Harvest, scrape or in any other way extract data from or on this Site or its users, using an automated, manual or other process.

  • Resell or make any commercial use of the Site or any Site content.

  • Modify, adapt, translate, reverse engineer, decompile, disassemble or convert into human readable form any of the Site content not intended to be so read, including using or directly viewing the underlying HTML or other code from the Services except as interpreted and displayed in a web browser;

  • Mirror, copy, imitate, download or store the Site or any Site content by any means, including but not limited to electronic, manual, mechanical or otherwise.

  • Harass, threaten, intimidate, mock, ridicule or in any other way make someone else feel uncomfortable through or using the Site.

  • Do anything that imposes an unreasonable or disproportionately large load on the Site, or interferes or disrupts the Site or any network or other website connected to the Site or owned or controlled or used by us.

  • Breach the security of the Site, test or scan the vulnerability of the Site, or make any unauthorised modifications to the Site.

  • Use the site in any manner that is contrary to the directions of a company officer of Ozeano, such as those directions may be made from time to time.

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

These Terms & Conditions prevail over all other clauses to the extent of any inconsistency, and states our entire liability for any claim or cause of action arising out of or in relation to these Terms. Nothing in these Terms & Conditions is to be taken to override or interfere with your statutory rights as a consumer under the Australian Consumer Law or other relevant Australian government legislation. To the fullest extent permitted by law, the liability of Ozeano for any loss or damage suffered by you as a result of Ozeano breaching its obligations under these terms or any other tortious duty (including arising by reason of defects in the products) is limited to a refund or replacement of the relevant products.
